This website, lauraprochowski.com (Website), is owned and operated by Laura Jane Prochowski (ABN 62 921 032 128) (Artist), who is committed to complying with the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (Privacy Act) and protecting the privacy of visitors and customers. By viewing and using the Website, you agree to both this Privacy Policy (Privacy Policy) and the Website Terms. You must not use the Website if you do not agree with either.
The Privacy Policy describes how the Artist collects, holds, uses and discloses your personal information, and how they maintain the quality and security of the same. Both this and the Website Terms are updated from time to time, so please ensure you are aware of the current version. What is personal information?
“Personal information” means any information or opinion, whether true or not, about an identified individual or an individual who is reasonably identifiable whether or not recorded in a material form. In general terms, this includes information or an opinion that personally identifies you either directly (e.g. your name) or indirectly.
What personal information is collected and how?
The personal information collected about you depends upon the nature of your dealings with the Artist and the Website, and may include your name, address, email, or phone number. Personal information is, for example, collected directly from you when you make contact via the phone, in person, or online, and is always required when you subscribe to the Artist’s mailing list or purchase an original creative works (Artwork). Otherwise, there is no obligation for you to provide personal information.
How is your personal information used?
Your personal information is only ever used in connection with your activities on the Website, which includes providing you with information, goods or services that you request, to deliver a responsive, personalised experience. Personal information may also be shared with third parties in circumstances where you would reasonably expect disclosure. For example, providing necessary contact details to a payment processor, IT service, or package courier.
Transfer of personal information overseas
The Artist uses third-party service providers to provide the Website and related services, such as Squarespace for content hosting and Stripe for payment services. Use of these providers requires the disclosure of personal information, where the providers may be based in, or have servers located outside of Australia, including in the United States. Where your personal information is disclosed to third parties overseas, the Artist will take reasonable to ensure that data security and appropriate privacy practices are maintained.
How is your personal information protected?
Reasonable steps will be taken to ensure that the personal information held about you is kept confidential and secure, including by:
limiting the storage of all personal information to one secure server;
not allowing any other party, other than authorised service providers, with access to personal information; and
having technological measures in place.
Direct marketing
You may be sent direct marketing communications and information about services, opportunities, or events that the Artist considers may be of interest to you if you have requested or consented to receive such communications. These communications may be sent in various forms, including email and SMS, in accordance with applicable marketing laws, including the Australian Spam Act 2003 (Cth). You consent to being sent those direct marketing communications by any of those methods. If you indicate a preference for a method of communication, the Artist will endeavour to use that method whenever practical to do so.
You may opt-out of receiving marketing communications any time by following the instructions to “unsubscribe'' set out in the relevant communication or contacting the Artist via email at laura@lauraprochowski.com.
Retention of personal information
Your personal information will be kept for no longer than is reasonably required, which in most cases means the duration of the relationship with the Artist unless the Artist is required to retain your personal information to comply with applicable laws (e.g. record-keeping obligations).
How to access and correct your personal information
The Artist will endeavour to keep your personal information accurate, complete and up to date. If you wish to make a request to access and / or correct the personal information held about you, please make a request by sending an email as outlined below under “How to contact the Artist”.
Links to third party sites
The Website may contain links to websites operated by third parties. If you access a third-party website through the Website, personal information may be collected by that third party. The Artist makes no representations or warranties in relation to the privacy practices of any third-party provider or website and is not responsible for the privacy policies or the content of any third-party provider or website. Third party providers / websites are responsible for informing you about their own privacy practices and the Artist encourages you to read their privacy policies.
How to contact the Artist
If you have a question, concern or complaint in relation to how your personal information is handled, processed or managed, please email laura@lauraprochowski.com. Note that your name, full details of your request, and proof of identity may be required before a complaint can be addressed. Please allow up to 10 business days to respond to a complaint. If you are not satisfied with the response, you have the right to raise the matter with the Office of Australian Information Commissioner (at www.oaic.gov.au/).
