LAURA PROCHOWSKI WEBSITE TERMS AND CONDITIONS (“Website Terms”)

This website, lauraprochowski.com (Website), is owned and operated by Laura Jane Prochowski (ABN 62 921 032 128) (Artist), and highlights a range of their original creative works, including oil paintings and illustrations (together, Artworks). By viewing and using the Website, including purchasing Artworks, you agree to both the Website Terms and the Privacy Policy, and you must not use the Website if you do not agree with them. The Website Terms and the Privacy Policy are both updated from time to time, so please ensure you are aware of the current version. Intellectual Property
All right, title and interest in materials on the Website, including images, videos, audio, text and logos, is owned or licensed by the Artist and protected under Australian copyright law. This includes any images of the Artworks, which must not be copied (in whole or in part), downloaded, published, stored, or otherwise used without the Artist’s prior written permission, and applies regardless of whether you have purchased the physical Artwork. If you are interested in reproducing an Artwork or any other materials on this Website, for commercial or other purposes, please email laura@lauraprochowski.com to discuss licensing.
Moral rights
When purchasing any Artwork from the Artist the buyer agrees that the Artist retains their moral rights under the Copyright Act 1968 (Cth), which remain in place irrespective of sale. The purchaser shall continue to respect these rights by:
attributing the Artist as the creator of the Artwork in any public display, publication, or reproduction;
not falsely attributing the Artwork to another person; and
not subjecting the Artwork to derogatory treatment, which is any act in relation to a work that is in any manner harmful to the Artist’s honour or reputation.
Artwork pricing, sales and delivery
The Artist may make Artworks available for purchase from time-to-time through the Website. All Artworks are sold at the price displayed unframed (unless otherwise noted) and comprised of the materials and in the dimensions outlined on the Website. A certificate of authenticity can be provided on request. Please choose carefully as, to the extent permitted by Australian consumer law, any Artworks or other items purchased through the Website are non-refundable and non-returnable, including for any change of mind.
Payment must be in provided full before any item is delivered. All prices are in Australian dollars and are inclusive of any Goods and Services Tax, but do not include the cost of delivery. Delivery costs shall be calculated and added to the cost of purchase once a valid postage address is provided. All items are insured for delivery to the listed value. Additional fees, such as customs duties, consumption taxes, and handling fees may apply to international deliveries, which charges remain at all times the responsibility of the receiver.
Disclaimer
The Artist makes no warranties as to the uninterrupted availability of the Website, or that it shall be free from any errors or viruses. The Artist accepts no responsibility for any loss or damage, however caused, that users may directly or indirectly suffer in connection with their use of the Website or any linked website, nor do they accept responsibility for any loss or damage arising out of a user’s use of, or reliance upon information contained on or accessed through the Website.
No data mining or automated access
You agree not to use any automated tools, including but not limited to bots, scrapers, crawlers, or artificial intelligence systems, to access, extract, download, copy, or otherwise collect data or content from this Website for any purpose, including training machine learning models or compiling datasets. Any such activity is strictly prohibited unless prior written consent has been obtained from the Artist.
Governing law
This Agreement shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia. The parties agree to submit to the exclusive jurisdiction of the courts of the State for any disputes arising out of or in connection with these Website Terms.
